These Terms and Conditions govern your use of thetatemple.com and the purchase of our products, services, digital content, and retreats (“Services”). By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site. You must be at least 18 years old to use this site.

1. About Us

The site is operated by EPO Performance Ltd, registered in England & Wales (No. 14355685) at 161 Seaforth Rd, L21 4LB, Liverpool, England. We trade as “Theta Temple”.

By accessing ThetaTemple.com, you agree to be bound by these Terms of Use and all applicable laws.

2. Using the Site

You agree not to:

Use the site for unlawful or abusive purposes.
Interfere with or disrupt site functionality.
Attempt unauthorized access to any systems or data.
Use automated tools to access or scrape the site.
Infringe any applicable laws or third-party rights.

We grant you a revocable, non-exclusive, non-transferable licence to access and use the site for personal, non-commercial purposes.

3. Intellectual Property

All content, logos, text, images, videos, and other materials on the site are owned by EPO Performance Ltd or our licensors. You may not reproduce or reuse this content without our prior written permission.

4) Accounts

If you create an account, you are responsible for keeping your login details secure and for all activity under your account. We may suspend or terminate accounts that violate these Terms.

5) Orders and Payments

When you place an order, you confirm that:

All information provided is accurate and complete.
You are authorized to use the payment method provided.
You understand the applicable product or service description, pricing, and any time-specific nature (e.g., retreat dates).

We may refuse or cancel orders where information is incorrect, payment is not authorized, or for fraud prevention. You will be notified if an order cannot be fulfilled.

6. Pricing, Taxes & Currency

Prices are shown at checkout and may include or exclude taxes depending on your location and the product. Any delivery, customs, or import charges (if applicable) are your responsibility.

7. Shipping & Delivery (Physical goods)

We aim to dispatch orders promptly. Delivery timeframes are estimates and may vary. Risk in the goods passes to you upon delivery. Please inspect items on arrival and contact us promptly about any issues.

8. Retreats & Events (date-specific services)

Retreats and events occur on specific dates. See Section 11 (Refund & Cancellation Policy) for the legal position and our goodwill windows. By booking, you confirm you meet any health, visa, or travel requirements and that you will comply with venue rules and our safety instructions.

9. Services & Appointments (coaching, classes, therapies)

You may reschedule or cancel up to 24 hours before your appointment at no charge. Late cancellations or no-shows may be charged 100% of the session fee unless we agree otherwise due to extenuating circumstances.

10. Digital Content (downloads, streams, online programs)

If you purchase digital content, you will not have the 14-day cancellation right once the download/stream begins where you gave explicit consent at checkout. If digital content is faulty, you are entitled to repair/replacement or, if that is not possible, a price reduction or refund.

11) Refund & Cancellation Policy

A) Distance sales of physical goods (change-of-mind)

You may cancel within 14 days of receiving your order.
After you tell us you’re cancelling, you have 14 days to return the goods.
We will refund the product price and the basic delivery cost within 14 days of receiving the goods back or evidence of return.
You are responsible for return postage unless the item is faulty or misdescribed.

B) Date-specific retreats & events

Bookings for retreats/events on specific dates are exempt from the standard 14-day cooling-off right (leisure activities on a specific date/period). Our goodwill policy:

≥ 60 days before the start date: full refund (less any non-recoverable third-party costs).
30–59 days: 50% refund.
< 30 days: non-refundable.
Name transfers allowed up to 7 days before the start date (no fee).

If we cancel, you will receive a full refund of all amounts paid for the retreat.

C) Services/appointments

Free reschedule/cancel up to 24 hours prior.
Late cancellations/no-shows: 100% fee may be charged.

D) Digital content

Cooling-off right is waived once download/stream starts with your express consent.
Faulty digital content: repair/replace; if not possible, price reduction or refund.

E) Faulty goods (summary)

Within 30 days of delivery: right to reject faulty goods for a full refund.
After 30 days: right to repair or replacement; if unsuccessful, you may be entitled to a price reduction or refund.

F) How to cancel or return

Email info@thetatemple.com with your order number, details, and (for goods) send returns to: Returns, EPO Performance Ltd, 161 Seaforth Rd, L21 4LB, Liverpool, England. Refunds are issued to your original payment method within 14 days of receiving returned goods or acceptable proof of return.

12. Health, Safety & Conduct (retreats and classes)

You are responsible for ensuring you are fit to participate. Always follow instructor guidance. We may refuse participation or ask someone to leave if behaviour is unsafe, disruptive, or offensive. You must inform us of relevant medical conditions or injuries and follow any medical advice from your healthcare professional.

13. User Content & Community Standards

If you post or submit content (reviews, comments, images):

You grant us a non-exclusive, worldwide, royalty-free licence to use and display such content.
You warrant your content is lawful, does not infringe third-party rights, and complies with these standards.
Do not post content that is defamatory, obscene, discriminatory, harassing, misleading, or spam. We may remove content at our discretion.

14. Third-Party Links & Advertising

The site may contain links to third-party websites or advertising. We are not responsible for such sites or content. Use of third-party links is at your own risk.

15. Disclaimers

The site and Services are provided on an “as is” and “as available” basis. We do not guarantee the site will be error-free, secure, or uninterrupted, nor do we guarantee the accuracy or completeness of any content.

16. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the site or Services. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be limited.

19. Governing Law & Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them are governed by the laws of England and Wales. You and we agree to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.
